Do foreigners have Constitutional rights?
Perhaps the better phrasing would be, "Can the US Government act against the rights ensured by the Constition, i.e. life, liberty, and property without the due process of law?" And the answer is a clear NO. The Supreme Court has ruled, appropriately, that just because someone is a foreigner does not give the US Government the right to deny Constititional rights. In other words, a government formed to create a more perfect union should not be in the business of ensuring rights for its citizens while ensuring injustice for foreigners.
I learned this via Glenn Greenwald and the Wick Yo vs. Hopkins case.
